Created register of trade union and employers' organizations

 

          On 06.07.2018, the National Assembly adopted on second reading the Act for Amendment and Supplement to the Labour Code, which was promulgated on 17.07.2018. The adopted amendments affect the establishment of a register of trade union and employers' organizations.

          Trade union organizations and employers' organizations acquire the status of a legal person after their entry in a register of trade union and employers' organizations at the respective district court at their registered office. A division of an organization registered under this order acquires the status of a legal person according to its articles of incorporation. The entries are made under the terms and following the procedure of Chapter fifty-five of the Civil Procedure Code.

          The following circumstances are entered in the register of trade union and employers' organizations:

1. the type and the name of the organization;

2. the seat and the address;

3. the articles of incorporation of the organization;

4. the bodies, the names of the members of the management body, the names and the positions of the persons representing the organization;

5. the termination of the organization;

6. the transformation;

7. the names and the address of the liquidators;

8. the cancellation of the organization.

          The changes of the abovementioned circumstances are also subject to entry.

          The circumstances and the acts are filed for registration, respectively for announcement in the register of trade union and employers' organizations at the respective regional court within one month from the day of their occurrence, respectively of their change.

          The property relations between the members of a terminated trade union organization as well as of a terminated employers' organization are settled in accordance with the provisions of their statutes.

          Trade union and employers' organizations, which have been established before the entry into force of this law, retain their status as a legal person without being entered in the register of trade union and employers' organizations at the respective district court at their registered office.
